This paper takes as starting point the relative indeterminateness of current legal systems. This circumstance determines from the point of view of judicial activity a substantial freedom for judges, which translates into the existence of different interpretive possibilities. For this reason the role of argumentationin judicial activity has been reinforced, but at the same time the question arises of how to control the judges and what kind of responsibility they have in exercising their functions.

According to the social ontology proposed by John Searle, there are ontologically objective facts or “brute facts”, independent from human attitudes, and ontologically subjective facts. Among the latter, the most notable are institutional facts, such as money or borders, which existence is explained through a collective attribution of status function within a certain social context. Could “moral truths” exist according to an ontology like this? Assuming the truth as correspondence, the notion of “moral truth” remits to the notion of “moral (...) fact”. As we will see, these moral facts, contrary to what authors such as Markus Gabriel suggest, are similar to institutional facts. For this reason, the truth or falsity of moral statements will be, as indicated by authors such as Gilbert Harman, relative to a social context; without that being an obstacle for acknowledging their expressive and directive function. La polémica entre feminismo y transactivismo lleva tiempo ocupando titulares, artículos, debates, etc. En este trabajo se intentan clarificar algunos de los problemas conceptuales que subyacen al conflicto. Para empezar, se abordan los conceptos de «sexo», «género» e «identidad de género» a partir del aparato conceptual proveniente de la ontología social presentada por John Searle. A continuación, ante la conveniencia de disponer de términos para hacer referencia unívoca a las personas de un sexo y de otro, se contrastan diferentes sentidos (...) de «mujer». La discusión de estas nociones permitirá abordar la cuestión política de fondo de si las categorías de género son un instrumento de opresión que abolir o, por el contrario, una identidad que reivindicar; así como una cuestión de cariz más jurídico como para qué deben servir las categorías «hombre» y «mujer» consignadas en leyes y documentos oficiales. Presento la trascendencia de la neurociencia para el estudio de la relación entre determinismo y libre albedrío. Diversos trabajos vinculan la actividad de ciertas áreas nerviosas con el desempeño de las funciones volitivas, el trabajo de Benjamin Libet y de Daniel Wegner otorga gran importancia al inconsciente en nuestros actos, y hay pruebas de influencia causal del entorno sociocultural sobre el cerebro del individuo. Todo esto sugiere una concepción determinista de nuestra voluntad, pero sostengo que ni esta ni la indeterminista (...) están claras actualmente y que se debe profundizar en la neuroplasticidad, las decisiones distales y la deliberación. Introducing the concept of Crisis Solution Marketing, this research explores how metaphor pre-packages information, proposing “solutions” to “problems” they discursively construct in the media. These conceptual frameworks are capable of influencing how readers perceive and interpret news events, ultimately influencing their behavior as consumers and the financial decisions they make. This article explores the relationship between editorial positioning and ideology in financial news and the types or ontologies of metaphors used to describe the nature of the stock market via reporting (...) on the stock market crash of 2008 in online news media. Results indicate a statistically significant preference for The New York Times and The Wall Street Journal, liberally positioned newspapers, for animate-biological metaphors which promote understanding of the stock market in terms of a living being that must be ‘nurtured’ through intervention as opposed to being ‘left alone’, which is more consistent with laissez-faire approaches to economic crisis scenarios. Patina is the word used for the green or brown film formed on the surface of old bronze, an excess of which can mask the true characteristics of the original masterpiece. Filippo Baldinucci used the word patina in a modern sense for first time in his book “Tuscan Vocabulary of the Art of Design”. Metaphors have been part of philosophical speech since the time of Plato. This figure of speech is used to attempt to provide a sensitive presence of an (...) idea to improve understanding and to make a more vivid perception of that concept. On analysing the creative process of contemporary re-search on health topics and its further dissemination, we defend the epistemological thesis that there is always some degree of patina on an original article and this may obscure the underlying scientific work. Conclusion: We consider that patina in scientific papers is very different from the concept of epidemiological bias. We think that any researcher who reads an original article acts as a restorer of knowledge. If a reader is aware of the existence of scientific patina, that reader will know how to look through it and see the masterpiece hidden underneath. (shrink)

Given the potential that environmentally oriented anti-consumption (EOA) has in achieving environmental sustainability, the authors draw upon marketing, management, environmental, and psychology studies to conceptualize and delimit EOA, differentiating it from other (related but distinct) phenomena. In addition, the authors review the available literature at the individual (micro) level and summarize research on the antecedents and meanings of broad and specific/strict EOA practices with different targets. Furthermore, the authors propose an agenda for future research, which reflects on EOA not only (...) at the individual (micro) level, but also lays out new opportunities for EOA work at organizational (meso), industry, and national (macro) levels. The work presented here hopes to spark multilevel research on EOA, its antecedents and consequences, and reactions to EOA phenomena. (shrink)

Recommending the identity of bidders in public procurement auctions has a significant impact in many areas of public procurement, but it has not yet been studied in depth. A bidders recommender would be a very beneficial tool because a supplier can search appropriate tenders and, vice versa, a public procurement agency can discover automatically unknown companies which are suitable for its tender. This paper develops a pioneering algorithm to recommend potential bidders using a machine learning method, particularly a random forest (...) classifier. The bidders recommender is described theoretically, so it can be implemented or adapted to any particular situation. It has been successfully validated with a case study: an actual Spanish tender dataset which has 102,087 tenders from 2014 to 2020 and a company dataset which has 1,353,213 Spanish companies. Quantitative, graphical, and statistical descriptions of both datasets are presented. The results of the case study were satisfactory: the winning bidding company is within the recommended companies group, from 24% to 38% of the tenders, according to different test conditions and scenarios. Due to the difficulty in solving combinatorial optimization problems, it is necessary to improve the performance of the algorithms by improving techniques to deal with complex optimizations. This research addresses the metaheuristics of marriage in honey-bees optimization based on the behavior of bees. The current study proposes a technique for solving combinatorial optimization problems within proper computation times. The purpose of this study focuses on the travelling salesperson problem and the application of chaotic methods in important sections of the MBO (...) metaheuristic. Three experiments were conducted to measure the efficiency and quality of the solutions: MBO with chaos to generate initial solutions ; MBO with chaos in the workers ; and MBO with chaos to generate initial solutions and the workers. The application of chaotic functions in MBO was significantly better at solving the travelling salesperson problem. (shrink)

The current times call for reforms in educational processes. The Covid-19 pandemic had an unforeseen impact on the educational system in all countries. This need for change requires new pedagogies and new methods for teaching and learning. Understanding the need for change is essential for the formulation of adaptive proposals, as well as for the generation of training activities to complement the teaching curriculum. New educational practices lead to a vision of educational quality, with new approaches that allow the continuous (...) integration of knowledge and permanent interaction with the student. This paper presents an analysis of the new teaching methodologies in times of confinement due to the pandemic caused by Covid-19. It has been shown that counterintuitive ideas from mythological and religious texts are more acceptable than other world knowledge violations. In the present experiment we explored whether this relates to the way they are interpreted. Participants were presented with verification questions that referred to either the literal or a metaphorical meaning of the sentence previously read, in a block-wise design. Both behavioral and electrophysiological results converged. At variance to the literal interpretation of the sentences, the induced metaphorical interpretation specifically facilitated (...) the integration of religious counterintuitions, whereas the semantic processing of non-religious counterintuitions was not affected by the interpretation mode. We suggest that religious ideas tend to operate like other instances of figurative language, such as metaphors, facilitating their acceptability despite their counterintuitive nature. (shrink)

Aims: Attentional bias, alcohol craving, and anxiety have important implications in the development and maintenance of alcohol use disorder. The current study aims to test the effectiveness of a Virtual Reality Cue-Exposure Therapy to reduce levels of alcohol craving and anxiety and prompt changes in AB toward alcohol content.Method: A 49-year-old male participated in this study, diagnosed with severe AUD, who also used tobacco and illicit substances on an occasional basis and who made several failed attempts to cease substance misuse. (...) The protocol consisted of six VR-CET booster sessions and two assessment sessions over the course of 5 weeks. The VR-CET program consisted of booster therapy sessions based on virtual reality exposure to preferred alcohol-related cues and contexts. The initial and final assessment sessions were focused on exploring AB, alcohol craving, and anxiety using paper-and-pencil instruments and the eye-tracking and VR technologies at different time points.Results: Pre and post assessment sessions indicated falls on the scores of all instruments assessing alcohol craving, anxiety, and AB.Conclusions: This case report, part of a larger project, demonstrates the effectiveness of the VR-CET booster sessions in AUD. In the post-treatment measurements, a variety of instruments showed a change in the AB pattern and an improvement in craving and anxiety responses. As a result of the systematic desensitization, virtual exposure gradually reduced the responses to significant alcohol-related cues and contexts. The implications for AB, anxiety and craving are discussed. (shrink)

Entre las razones por las que vale la pena estudiar este libro de Reyes Mate, quisiera adelantar dos: la primera, tiene que ver con la relación entre justicia y memoria. No hay justicia sin memoria afirma Mate, en una apuesta por pensar la justicia desde la memoria, asunto que me parece un reto filosófico y político para contextos como el colombiano. La segunda, consiste en el tratamiento que hace de la justicia; no estamos frente a un comentarista de los teóricos (...) de la justicia sino de un examen crítico de las confusiones que llevan la reflexión filosófica a un callejón sin salida para responder a la injusticia. Las familias españolas y occidentales tienen problemas en la comunicación diaria. Esa incomunicación también se da en los distintos niveles del sistema educativo: la ESO, el Bachillerato, la FP y la Universidad. Esto afecta a nuestra juventud entre los 13 y 18 años, que, salvo ejemplos excepcionales, vive desorientada sobre qué quiere hacer con su vida. A pesar de la existencia de orientadores en los centros educativos, la escasez de recursos humanos en esa tarea, unida al obsesivo objetivo por aprobar (...) cursos y la EvAU, está lastrando la formación y orientación de nuestra juventud. Preguntas decisivas que todos nos hacemos a lo largo de la vida u otras que afectan a las relaciones interpersonales, intergeneracionales y sociales no se abordan de frente porque las personas, las familias, los centros educativos, desde los institutos hasta las universidades, y las instituciones administrativas y políticas las están obviando. En este artículo se recurre a las experiencias de vida para reflejar nuestro tiempo, y la necesidad de mejorar los hábitos cotidianos practicando una educación interdisciplinar en formación vocacional, inteligencia emocional y sentimental, educación cívica y moral, formación histórica, instrucción jurídica, educación intergeneracional o en la mirada crítica sobre los medios de comunicación y las redes sociales. La metodología aplicada será la filosofía de la razón vital e histórica y la teoría de las generaciones de Ortega y Gasset y de Julián Marías (Marías, 1961: 1). Además, se recurre a estudios nacionales e internacionales para aportar información, conocimiento y análisis clarificadores. (shrink)
